This fixed the issue, fort no longer attacks when I use a french-friendly flag <img src="style_emoticons/<#EMO_DIR#>/smile.gif" style="vertical-align:middle" emoid="" border="0" alt="smile.gif" />

Black Pearl still attacks, but that is no big deal (I would expect a pirate ship to attack).

I didn't try my own flag, unfortunately I have saved past that point. I will try with an older save however, but it will take my a bit of time to catch up. I'll keep you posted.

Okay, I tested the Black Pearl first encounter again with my personal flag, still hostile.

I also noticed that the first time I sailed to (with British flag) at Speightstown to talk with the shipwright that the fort was hostile, however I sailed to bridgetown and back and it was no longer hostile. I tried another 3 or 4 times going to world map and back to harbour and it was not hostile. So there might still be issues with the updates to the AI, but it seems much, much less likely to occur as before it would happen every time.
