If you haven't talked with the merchant at all and you kill him no reinforcement arives.

I know. But if you don't look at his wares, he doesn't have any. And if he doesn't have any, there is little to gain from the theft.
So I don't see a need for the huge penalty for doing it. After all, you're not getting the reward either. :shrug

Hmmm...for now not a bug. For beta5 I'm probably going to rewrite a lot of storekeeper related code anyway so then I'll fix it.
